These Terms and Conditions apply to the sale of products, custom-made items and services provided by Simatos Panagis & Co. G.P. / 342 / Inside-Gallery, unless otherwise agreed in writing.
Submitting, accepting or signing a quotation or order constitutes acceptance of the approved order details and of these Terms and Conditions.
Before an order is finalised, the customer is responsible for checking the dimensions, quantities, materials, colours, finishes, hardware, drawings and all other technical specifications.
Any error or discrepancy must be reported immediately and before production begins or materials are ordered. After approval, subsequent changes may result in additional charges and may affect the estimated delivery time.
All stated prices are in Euro (€) and include VAT unless expressly stated otherwise.
For custom-made and made-to-order products, the agreed deposit is the amount or percentage stated in the relevant quotation or order. The deposit is required to confirm the order and begin procurement of materials or production.
The deposit is non-refundable in the event of cancellation or a change of mind by the customer, unless an exception is expressly approved in writing by the company for special reasons, subject to any rights that cannot be excluded under applicable law.
The outstanding balance is payable in accordance with the payment terms stated in the quotation, order confirmation or relevant invoice/document. Ownership of the products remains with Simatos Panagis & Co. G.P. until full payment has been received.
Custom-made products are manufactured according to the dimensions, specifications and selections approved by the customer.
Where dimensions are supplied by the customer or by a third party acting on the customer's behalf, the company is not responsible for problems arising solely from incorrect or incomplete measurements.
Where measurements are taken by the company or by an authorised partner, responsibility for the accuracy of those measurements lies with the company, subject to any subsequent changes made to the installation area.
Photographs, drawings, renders and samples are indicative. Minor variations in colour, grain, texture and detail may occur due to the natural characteristics of the materials or the manufacturing process.
The delivery time stated in the quotation or order is an estimate unless a specific binding delivery date has been expressly agreed in writing.
For custom-made products, production time begins after the order has been finalised, the agreed deposit has been paid and, where applicable, the final drawings, dimensions, materials and colours have been approved.
Delays caused by suppliers, transport companies, shortages of raw materials or other circumstances not attributable to the company may affect the estimated delivery time.
Transport, delivery and installation are included only where expressly stated in the quotation or order.
Customers should inspect products and packaging upon delivery and report any visible damage or shortage immediately. Where goods are transported by a third-party transport company, visible damage should also be recorded on the relevant delivery document.
The installation area must be ready, clear, accessible and suitable for the work to be carried out.
The customer must inform the company in advance of access restrictions, stairs, lifts, narrow openings, fragile surfaces, concealed electrical or plumbing installations and any other site condition that may affect transport or installation.
Irregularities in walls, floors and ceilings, as well as minor adjustments, fillers, joints and tolerances, may be necessary for the proper fit of custom-made products.
Additional work, delays or repeat visits resulting from undisclosed or unsuitable site conditions may be charged separately after the customer has been informed.
Where transportation, assembly or installation is carried out by the customer or by a third party not appointed by the company, the company is not responsible for damage resulting from incorrect transportation, storage, assembly or installation.
The customer must use, clean and maintain products in accordance with their intended use and any maintenance instructions provided.
Damage, wear or failure resulting from misuse, impact, excessive weight or stress, unsuitable cleaning products, moisture, water, heat, incorrect assembly, or alteration or intervention by the customer or a third party is not considered a manufacturing defect and does not create an obligation for free repair or replacement, subject to applicable law.
Cancellation or amendment before production begins or before special materials are ordered will be considered on a case-by-case basis.
Once special materials have been ordered or production of a custom-made product has begun, cancellation or amendment may result in charges for materials, labour and other costs already incurred. The agreed deposit remains non-refundable in the event of cancellation or change of mind by the customer, except where the company expressly agrees otherwise in writing for special reasons or where applicable law requires otherwise.
For purchases made in a physical store, returns of non-defective products are accepted only where permitted under the company's applicable commercial return policy.
For distance contracts, any right of withdrawal provided by applicable law shall apply. The right of withdrawal does not apply in cases excluded by law, including products manufactured according to the customer's specifications or products that are clearly personalised.
In the event of a proven defect or lack of conformity, the rights provided by applicable law shall apply.
Depending on the product and the nature of the issue, the remedy may be carried out either by the relevant supplier or manufacturer, or by Simatos Panagis & Co. G.P. where the product has been manufactured by us.
Any warranty provided by a supplier or manufacturer applies in accordance with that supplier's or manufacturer's terms and does not limit the customer's statutory rights.
Solid wood is a natural and hygroscopic material and is affected by temperature, humidity, dryness, sunlight and the environmental conditions of the space in which it is used.
Over time, natural changes may occur, including small cracks or checks, openings at joints, minor dimensional movement, warping, bowing, colour variation and changes in the appearance of the wood grain.
In laminated or glued timber surfaces and individual wooden components, movement or openings may also occur as a result of the natural expansion and contraction of the wood. Such changes are assessed in relation to their extent, the use of the product, environmental conditions and the way the product has been maintained.
These natural characteristics do not exclude the possibility of a genuine manufacturing defect, which will be assessed separately.
Wooden products finished with oil require periodic cleaning and maintenance. Inspection and, where necessary, reapplication of oil is recommended approximately every 6 months, depending on use and environmental conditions.
For products finished with varnish, the surface should be inspected and, where necessary, maintained or refinished approximately every 2–3 years.
For outdoor products or items exposed to strong sunlight, moisture, water, salt or significant temperature changes, maintenance may be required more frequently. Failure to carry out the necessary maintenance may affect the appearance and service life of the product.
The company is not liable for delays or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, strikes, transport or production problems, shortages of raw materials, supplier shutdowns, governmental actions or other events of force majeure.
The company may update these Terms and Conditions for future transactions. Any changes will not affect orders that have already been finalised unless otherwise agreed in writing with the customer.
These Terms and Conditions are governed by Greek law and the applicable law of the European Union.
If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Any dispute should first be resolved amicably where possible. If this is not possible, the rules of jurisdiction provided by applicable law shall apply.
